These Terms of Service ("Terms") govern your access to and use of the ICR Paints website (www.icrpaints.com) and the ICR Paints application portal (app.icrpaints.com) (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering an account, browsing, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform.

• You have the authority to bind the business or entity you represent
• All information provided during registration is accurate, current, and complete

3. Account Registration

To access certain features, you may be required to register an account on app.icrpaints.com. During registration, you may be asked to provide personal and business information including your name, phone number, email address, company name, GST number, business type, and address.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that provide false, misleading, or incomplete information.

4. Products and Services

The Platform serves as a product catalogue and enquiry portal for ICR Paints products. Please note:

• Product information — descriptions, images, specifications, and colour representations on the Platform are for informational purposes only. Actual products may vary due to screen settings, manufacturing processes, and batch variations
• Colour accuracy — colours displayed on screen are approximations only. We recommend requesting physical colour swatches or samples before making purchasing decisions
• Pricing — product prices listed on the Platform, if any, are subject to change without prior notice. Final pricing is confirmed at the time of order
• Availability — product availability may vary by region and is subject to change without notice

5. Enquiries and Orders

Submitting a product enquiry through the Platform does not constitute a binding order or purchase. Enquiries are forwarded to our sales team for follow-up. An order is only confirmed upon written acknowledgement from ICR Paints, including agreed terms of pricing, quantity, and delivery.

6. Intellectual Property

All content on the Platform — including but not limited to text, logos, images, product descriptions, graphics, trademarks, and software — is the property of ICR Paints or its licensors and is protected by applicable intellectual property laws.

You may not:

• Copy, reproduce, distribute, or create derivative works from any content on the Platform
• Use ICR Paints trademarks, logos, or branding without prior written consent
• Scrape, data-mine, or use automated tools to extract content from the Platform

7. Acceptable Use

You agree not to:

• Use the Platform for any unlawful, fraudulent, or unauthorized purpose
• Impersonate another person or entity, or misrepresent your affiliation
• Upload malicious code, viruses, or any harmful content
• Attempt to gain unauthorised access to other accounts, systems, or networks connected to the Platform
• Interfere with or disrupt the Platform's functionality or associated infrastructure

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
• ICR Paints shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
• Our total liability for any claim arising from or related to the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or ₹1,000, whichever is greater
• We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components

9. Indemnification

You agree to indemnify, defend, and hold harmless ICR Paints, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Platform, violation of these Terms, or infringement of any third-party rights.

10. External Links and Third-Party Services

The Platform may contain links to external websites or services, including WhatsApp for product enquiry submissions. We are not responsible for the content, privacy practices, or availability of these third-party services. Your use of external services is governed by their respective terms and policies.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reasonable cause.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
